This ESCO Agreement (the “Agreement”) is between the State of Oregon, acting by and through its Department of Energy, hereafter called “Agency” and ESCO NAME, a STATE NAME & ENTITY TYPE, hereafter called “ESCO”, collectively the “Parties” and individually a “Party.”
