This Merchant Program Agreement (the “Agreement”) is by and between Member Bank, (“Bank”), Aurora Payments LLC (“ISO”) and the merchant (“Merchant”) identified in the Merchant Application (“Merchant”). Merchant has completed and submitted to ISO/Bank an application for services that provides information about Merchant’s business and processing needs (the “Merchant Application”). As part of the Merchant Application, Merchant has certified that it has read this Agreement, and understands and agrees that the terms of this Agreement will be binding upon it if and when ISO/Bank approves the Merchant Application ((including the Fee Schedule attached thereto “Fee Schedule”) to receive requested services. A MERCHANT’S SUBMISSION OF A TRANSACTION TO ISO/BANK SHALL CONSTITUTE RATIFICATION OF EACH AND ALL OF MERCHANT’S OBLIGATIONS UNDER THIS AGREEMENT.
