To define an agreement between known herein as the “Donor”, and The Batiquitos Lagoon Foundation (BLF), known herein as the “Recipient”, for the purchase option and dedication of one bench along the North Shore Trail or Cholla Point at the Batiquitos Lagoon, Carlsbad, California.

The length of a bench dedication is 10 years from the date this agreement is signed. As this is considered a non-permanent Garden feature, we cannot guarantee perpetuity of recognition. Given the material and finishing, The Montclair Foundation/Van Vleck House & Gardens agrees to maintain this bench for 10 years at which defined point it cannot be repaired or kept in good or safe condition. At that point, it will be removed from the Garden. After 10 years, the donor will be contacted and given the opportunity to make an additional contribution to renew the dedication for another ten-year period. If Garden design changes or eliminates the chosen location within the 10 year period, the donor will be informed and staff will work with the donor to determine an alternate location for the item.
