pursuant to the provisions of Arizona Revised Statutes (“A.R.S.”) §§ 5-801 et seq., as the same may be modified or amended (collectively, the “Act”), as a corporate and political body of the State of Arizona and, except as otherwise limited, modified or provided by the Act, as a tax levying public improvement district (hereinafter called the “Authority” or a “Party”). The Recipient and the Authority are sometimes hereinafter collectively called the “Parties.”
