THIS BIOLOGIC PRODUCTS COMMERIALIZATION AGREEMENT (the “Agreement”) is made and entered into as of this 17th day of August, 2004 by and between BioVest International, Inc., a Delaware corporation with its principal place of business located at 8500 Evergreen Blvd. NW, Minneapolis, MN 55433 (“BioVest”) and Accentia, Inc., a Florida corporation with its principal place of business located at 5310 Cypress Center Drive #101, Tampa FL 33609.
