The Monte Vista Water District (MVWD) is constructing a groundwater treatment facility with an ion exchange water treatment system servicing Well No. 34 located at 4584 Palo Verde St. in the City of Montclair. The location of the facility is identified as part of the Capacity Rights Agreement. The facility is designed to pump and treat groundwater, and MVWD has submitted a capacity rights application requesting to purchase one Etiwanda Waste Line Capacity Unit.

This Amendment No. 2 (this “Amendment”) dated April 1, 2011, amends that certain Amended and Restated Capacity Rights Agreement dated July 1, 2010, as amended by Amendment No. 1 to Amended and Restated Capacity Rights Agreement, dated December 16, 2010 (as amended, the “Original Agreement”), by and between Sabine Pass LNG, L.P., a Delaware limited partnership (“Sabine”) and JPMorgan LNG Co., a Delaware company (“LNGCo”).
