This First Amendment to the Center City Housing Incentive Policy Agreement of the City of San Antonio (“First Amendment”) is entered into by and between the City of San Antonio (“City”), a municipal corporation governed by the laws of the State of Texas, acting by and through its City Manager or designee, the Midtown Tax Increment Reinvestment Zone #31 (the “TIRZ”), acting by and through its Board of Directors, and 120 Ninth Apartments, LLC. (“Developer”). Together, City, TIRZ, and Developer may be referred to herein as “the Parties.” The Center City Housing Incentive Policy Agreement of the City of San Antonio and its amendments are subsequently collectively referred to as the Agreement.
