THIS AGREEMENT (hereinafter the “Contract” or the “Agreement”) is made by and between the People of the State of New York, acting by and through the Commissioner of the New York State Office of General Services (“OGS”), acting pursuant to authority granted under State Finance Law §163, whose office is on the 41st Floor, Tower Building, Governor Nelson A. Rockefeller Empire State Plaza, Albany, New York 12242 (hereinafter “OGS” or “State”), and JP Bus & Truck Repair LTD, D/B/A Bird Bus Sales (herein after “Contractor”) with offices at 135 Haven Avenue, Port Washington NY 11050. OGS and the Contractor are collectively referred to herein as “the Parties.”
