[1] By Fixed Date Claim form, the Claimant claimed against the Defendant that there had been breaches or likely to be breaches of his fundamental rights and freedoms enshrined in Sections 4A, 4B and 4D of the Constitution of Trinidad and Tobago, by reason of the fact that he claimed to be entitled to an amnesty with respect to contributions to the Defendant which had been granted in September 2011 by the then Minister of Finance. This is contained in the NIB Act Section 39C thereof.

[1] This matter was commenced by Fixed Date Claim supported by affidavit of the Claimant both filed on April 7, 2017. In his affidavit, he swore, inter alia, that as early as 1979 he was in possession of a piece of land situate at LP 51-3 Murli Street, La Romain, in the Island of Trinidad. The said parcel of land formed part of a larger parcel, the former, which is more particularly described in the Deed of Partition dated April 1, 1980 bearing registration No. 9972 of 1980. In the said Deed, the First Defendant became seised in fee simple in possession of the apportioned parcel of land.
