entered by and among Plaintiff Mark Trietsch, individually and on behalf of the Settlement Class (“Plaintiff”), and Defendant American Family Mutual Insurance Company (“American Family”), and replaces the CLASS ACTION SETTLEMENT AGREEMENT AND RELEASE previously executed by the Parties. Plaintiff and American Family are referred to collectively as the “Parties.” Subject to Court approval, as required by the applicable Rules, and as is provided herein, the Parties hereby stipulate and agree that, in consideration of the promises and covenants set forth in this Agreement and upon the entry by the Court of a Final Approval Order, it is the express intention of the Parties to fully, finally and forever resolve, discharge and settle all claims which were brought or could have been brought in the above-captioned lawsuit (“Lawsuit”), by Plaintiff or any Class Member who declined to opt out of this Agreement as set forth below and who therefore constitute a member of the Settlement Class.
