This Mitigation Agreement (“Agreement”) dated as of the date of the last execution of a party hereto is entered into by and among The Marshall County Coal Company and Consolidation Coal Company (hereinafter, collectively, “Mining Companies”), on the one hand, and Dominion Energy Transmission, Inc., Columbia Gas Transmission, LLC, Texas Eastern Transmission, LP, UGI Appalachia, LLC, and Williams Ohio Valley Midstream LLC (hereinafter, collectively, “Pipeline Operators”), on the other hand. Mining Companies and Pipeline Operators are referred to, collectively, as the “Parties.”
