In recent years, many large urban development projects have gone forward in conjunction with community benefits agreements (CBAs). CBAs have gen- erated tremendous excitement among community groups and advocates of equitable development, as well as substantial interest in local government, academia, the media, planning circles, and philanthropic foundations. This new approach has led to exceptional results in some cases, and it holds tre- mendous promise as a means of ensuring delivery of community benefits on controversial development projects. However, CBAs have the potential for misuse and have substantial limitations as a long-term strategy in com- munity economic development. For these reasons, CBAs should not supplant broader efforts to improve the land use development process, especially in low-income urban areas.

Large projects are often controversial projects, with wide ranging implications for host localities. Energy projects, including windfarms, nuclear power stations, and the more recent cases of fracking and nuclear waste geological disposal, provide particularly high profile cases. In response to concern there has been the emergence of a whole family of new procedures, processes and methods for their assessment and management, including the advent of Community Benefit Agreements (CBAs). This article examines some of the critical issues around the increasing use of such agreements, including: their justification, relationship to the planning process, scale of benefits (which can be very large), types of benefits, and their management and distribution. The focus is on emerging UK practice in relation to energy projects, but there will also be reference to some relevant practice elsewhere—especially in the EU and North America.

A community benefits agreement (CBA) results from negotiations between a developer proposing a particular land use and a coalition of community organizations that claims to represent the individuals and groups affected by the proposed development.1 In a typical CBA, community members agree to support the developer’s proposed project, or at least promise not to oppose the project or to invoke procedural devices or legal challenges that might delay or derail the project. In return, the developer agrees to provide to the community such benefits as assurances of local jobs, affordable housing, and environmental improvements.2

Abstract: In the United States, developers are obliged to take into account Environmental Justice (EJ) issues in order to achieve their facility projects, from a procedural and distributive point of view. The community benefits agreements are among some of the local regulation mechanisms, which contribute to better equity in the allocation of bad and good effects of an impacting facility. Only packages of manifold measures can tackle socio-environmental inequalities: reducing social vulnerability of community groups, increasing their social and political resources and benefiting from opportunities.
