SENATOR DIERKS: Mr. Speaker and members of the Legislature, I just want to stand again in opposition to this amendment. I understand where Senator Landis and Senator Beutler are coming from but I don’t think that this was the intent of the original compact agreement. The intent of that agreement was very plainly that there would be community consent and they di d n ’t stipulate the first county that gets it, or the second one or the last one. They just said there will be community consent. Now this was a stipulation that Governor Orr put on the compact before we would accept the waste site in Nebraska and the compact agreed to it. We had that same stipulation by the members of the county board in Boyd County. They said, we will invite you to come here and look but if you d o n ’t...but we have the right to community consent or we won't support the siting here. We have this all documented in that little handout that I have given you. I hope you will take time to read that. I think that

On October 7, U.S. Ambassador Asif J. Chaudhry, Millennium Challenge Corporation (MCC) Acting Vice President for Compact Development Darius Teter, and Moldovan Prime Minister Vlad Filat signed an agreement to provide USD 3.19 million in operating costs for the MCC in Moldova. The funding will go towards the establishment of fiscal, procurement, and administration agents for the implementation of an MCC Compact, which, if approved, will support road rehabilitation and also include an agriculture component to promote the transition to high value agriculture. The funds will also provide support for the Millennium Challenge Account Moldovan staff.

If that contract has been published by the Secretary in the Federal R e g i s t e r . by federal law, that compact is valid. I'm concerned about that because I ...and I guess I agree that we ought to establish and set public policy as to what the Governor should or should not be able to do. My feeling :.s that perhaps that should have been done before the compact was negotiated but it' s certainly something that we should do in the future to ensure that the G overnor does not negotiate outside of the parameters of what public policy is set by this body. I'm concerned, however, that if that compact is valid right now, what we' re doing is basically saying we' re not going to... that compact is really not valid and we can go back and change what we want to do. I think, from Senator Beutler' s comments, he has a legitimate concern that, in fact, we should change part of that compact.
