This Amendment No. 3 to Confidential American Eagle Charter Agreement (the “Amendment No. 3”) is made by and between Executive Airlines, Inc., located at: LMM International Airport, Base Muniz, Central Sector, Carolina, Puerto Rico 00979, Fax: 787-253-6368, American Eagle Airlines, Inc., located at: 4333 Amon Carter Boulevard, Fort Worth, Texas 76155 (collectively, “America Eagle”), and Air Partner Inc., located at: 1100 Lee Wagener Boulevard Suite 328, Fort Lauderdale, FL 33315, Telephone: 954-359-4019, Fax: 954-359-3930, Mobile: 954-618-3859 (“Charterer”). For purposes of this Amendment No. 3, American Eagle and Charterer may be each referred to individually as a “Party,” and collectively, as the “Parties.” Amendment Eagle Airlines, Inc. plans to change its name to Envoy Air Inc. after the date of execution of this Amendment No. 3; thereinafter, the definition “American Eagle” shall include Envoy Air Inc.
