This Connecticut Settlement Agreement (this “Agreement”), effective as of February 9, 2006 (the “Effective Date”), is entered into by and between MJ Research, Inc., a Massachusetts corporation with offices at 590 Lincoln Street, Waltham, Massachusetts 02451 (“MJ Research”), John Finney, an individual residing at 774 Mays Boulevard #10, PMB 352, Incline Village, NV 89451-9613, Michael Finney, an individual residing at 489 Douglass Street, San Francisco, CA 94114-2725, MJ Bioworks, Inc., a Delaware corporation with offices at 384 Oyster Point Blvd. #8, South San Francisco, California, MJ Geneworks, Inc., a Wisconsin corporation with offices at 1100 Dallas Street, Sauk City, Wisconsin, Bio-Rad Laboratories, Inc., a Delaware corporation with offices at 1000 Alfred Nobel Drive, Hercules, CA 94547 (“Bio-Rad”) and its and their Affiliates (as defined below) (each of the foregoing an “MJ Party” and, collectively, “the MJ Parties”), on the one hand, and Applera Corporation, a Delaware corporati
