This cutting edge agreement or Consent Decree builds upon the cleanup plan described in EPA’s December 2004 Record of Decision. The agreement integrates Superfund remediation with site restoration activities into a seamless process that will result in a safe drinking water supply, improved native and sport fishery, and restored Clark Fork and Blackfoot Rivers in southwestern Montana. In June 2013, the San Antonio Water System (SAWS) approved a settlement agreement, or consent decree (CD), with the U.S. Environmental Protection Agency (EPA) to reduce spills from sanitary sewer overflows (SSO); thus joining over 35 other cities across the country working under EPA consent decrees to reduce sewer spills. Under the CD, SAWS will invest an estimated $492 million over the next 10 years to reduce SSOs and maintain its sewer system infrastructure. The work required to comply with the CD over the project term includes system-wide inspection, cleaning and evaluation of sewer pipelines, and targeted replacement and rehabilitation of aging infrastructure. This presentation will review the typical EPA CD development processes and also include an overview of the key elements of the SAWS CD.

In a consent decree reached with the Natural Resources Defense Council (NRDC) and other environmental groups, published in the Federal Register on February 3, the agency agreed to issue a proposed rulemaking within two years of the final date of the consent decree "pertaining to the issuance of the Hazardous Substance Worst Case Discharge Planning Regulations."
