THIS MODIFICATION TO CONSTRUCTION LOAN AGREEMENT AND OTHER LOAN DOCUMENTS (the “Modification Agreement”) effective as of November 16, 2012 is made by and among HF LOGISTICS-SKX T1, LLC, a Delaware limited liability company (“Borrower”), BANK OF AMERICA, N.A. (“Bank of America”) as Administrative Agent, for itself as a Lender and each Lender from time to time a party to the Agreement as defined herein (each individually, a “Lender” and collectively, the “Lenders”), RAYMOND JAMES BANK, N.A.
