CMS and the Card Sponsor, an entity that has been determined eligible to operate a Medicare-approved prescription drug discount card by the Administrator of CMS under 42 CFR §403.806, agree to the following for the purposes of section 1860D-31 of the Social Security Act (hereinafter referred to as “the Act.”)
