CMS and the PDP Sponsor, an entity that has been determined eligible to operate a Voluntary Medicare Prescription Drug Plan by the Administrator of CMS under 423 CFR §423.503, agree to the following for the purposes of sections 1860D-1 through 1860D-42. (with the exception of sections 1860D-22(a) and 1860D-31) of the Social Security Act (hereinafter referred to as “the Act.”)
