On 25 May 2021, the applicant's request to set aside a judgment entered against her in Default of Appearance was dismissed in the Supreme Court. The applicant filed a Notice of Motion seeking leave to appeal to the Court of Appeal, alleging that the judge made several errors, including not accurately reflecting the procedural rules in dealing with the issue of delay in setting aside a regular judgment entered in default of appearance and neglecting to consider whether justice could have been served by setting aside the judgment in default of appearance on specific terms. The applicant also sought an extension of time within which to bring the appeal. On 23 January 2023, the Court heard the parties and reserved its decision.
