This Data Processor Addendum (“DPA”), as amended from time to time, is an integral part of the Terms of Service available at https://ermetic.com/terms-of-service/ to which this DPA is linked or other agreement governing the use of Ermetic’s services ("Agreement") by and among the applicable entity of Ermetic with which the Agreement was executed (”Ermetic”) and the entity or entities who are a party to the Agreement. This DPA shall have effect on the date the Agreement becomes effective.

This Data Processor Addendum (the “DPA”) forms part of that certain Accellion Solutions License Agreement (the “Agreement”) dated by and between (the “Customer”) and either Accellion USA, LLC or Accellion Pte Ltd. (each together with its affiliated companies, “Accellion”). It is entered into for compliance with the General Data Protection Regulation (EU) 2016/679 (the “GDPR”).

This Data Processor Addendum (“Addendum”) forms part of the Master Service Agreement (including any and all Service Schedules and Service Orders incorporate therein, as amended) or other written agreement (“Agreement”) between Zayo Group, LLC (“Zayo”) and the Zayo customer identified on the applicable Zayo ordering document for Zayo services (“Customer”). Other than as set forth in this Addendum, the Agreement remains unchanged and in full force and effect.
