This Agreement (hereinafter referred to as “Agreement”) is entered into by and between the City of College Station, Texas, (hereinafter referred to as the “City”) and Crowley Development Corporation, a Texas corporation, having its principal address at 1301 McKinney, Suite 3500 Houston, Texas 77010 (hereinafter referred to as the “Developer”) on this __________ day of May, 2003, and is a participation agreement to relocate the construction of a TxDOT crossover at the intersection of Greens Prairie Road and future State Highway 40 (“SH 40”) (hereinafter referred to as the “Project”) and align it with Decatur Drive.
