EXHIBIT 10.13 THE CHEESECAKE FACTORY INCORPORATED Peter J. D’Amelio Employment Contract AGREEMENT This AGREEMENT (the “Agreement”) is entered into this 29th day of August, 2001 between THE CHEESECAKE FACTORY INCORPORATED (the “Company”) and Peter J. D’Amelio (“Executive”). WHEREAS, the parties desire to enter into this Agreement setting forth certain terms and conditions of the employment relationship of Executive with the Company. NOW, THEREFORE, in consideration of the promises and mutual covenants and agreements herein contained and intending to be legally bound hereby, the Company and Executive hereby agree as follows: 1. Employment. Executive is employed as the Senior Vice President of Restaurant Operations of the Company. In this capacity, Executive shall have such duties and responsibilities as may be designated to Executive by Chief Executive Officer of the Company from time to time.
