THIS FIFTH AMENDMENT of the Agreement For Energy Performance Contracting Services Formerly Pursuant to TCPN Solicitation Number 12-54 and Now Pursuant to TIPS Contract No. 22010601 (the “Fifth Amendment”) is made and entered into by and between Fort Bend County, (hereinafter “County”), a body corporate and politic under the laws of the State of Texas, acting herein by and through its Commissioners Court, and Schneider Electric (hereinafter “Contractor”), a company authorized to conduct business in the State of Texas (hereinafter collectively referred to as the “Parties”).
