This Enterprise Solutions Agreement (“Agreement”) contains the terms and conditions that govern Your access to and use of the Software and the Dashboard Services described below, and is a legally binding contract between the entity or company you represent (“You” or “Your”) and HTC Corporation and/or one or more of its affiliates (collectively, “HTC”). You and HTC may be individually referred to as a “Party” and collectively as the “Parties”. This Agreement is effective on the date You click to accept or when You begin use of the Software or Dashboard Services, whichever event occurs first (“Effective Date”). You represent that You are lawfully able and have full legal authority to enter into this Agreement (e.g. are competent and of legal age and have full legal authority to bind the entity or company You represent).
