Contract Type FiledOctober 25th, 2020The Department of Toxic Substances Control (DTSC) and the California Redevelopment Association (CRA) have jointly developed the attached Proto- type Environmental Oversight Agreement (EOA) to facilitate the environmental assessment, cleanup and re-use of brownfields sites by Redevelopment Agen- cies (RDAs) throughout California. Unlike DTSC’s typical Voluntary Cleanup Agreement under Chapter 6.8 of the Health & Safety Code, DTSC can pro- vide RDAs with technical assistance and consultation and supervise site clean- ups without the RDA being designated as a “responsible party.” The Proto- type EOA is now available for use by individual RDAs and DTSC regional offices and can be modified to meet the specific objectives of the RDA and address the unique requirements of the site or the RDA’s project area. The EOA is also designed to facilitate remedial actions taken by an RDA exer- cising its authority under the Polanco Redevelopment Act set forth in Health & Safety Code §§ 33459-33459.8 (P

Contract Type FiledJanuary 31st, 2002The California Environmental Protection Agency’s Department of Toxic Substances Control (DTSC) is responsible for overseeing the environmental assessment, investigation and cleanup of proposed and expanding school properties. As set forth in the California Education Code, Section 17213.1, the Environmental Oversight Agreement (EOA) authorizes DTSC to guide and oversee school districts through the preparation of a Preliminary Endangerment Assessment (PEA) for the proposed/expansion school sites. The EOA is an agreement, not an enforcement order. It provides a mechanism for the school districts to perform a PEA under the oversight of DTSC. The PEA will determine if there has been a release or if there is a potential for release of hazardous material, which could pose a threat to public health or the environment. After reviewing the PEA, DTSC will issue a determination of either “No Further Action” or “Further Action.”
