This Escrow Fund and Account Control Agreement (this “Agreement”), dated as of November , 2024, by and among BMO HARRIS INVESTMENT COMPANY LLC, a Nevada limited liability company (hereinafter referred to as “Lessor”), VILLAGE OF HOMEWOOD, a city body corporate and politic existing under the laws of the State of Illinois (hereinafter referred to as “Lessee”) and THE BANK OF NEW YORK MELLON TRUST COMPANY, N.A., a national banking association (hereinafter referred to as “Escrow Agent”).
