This Ethanol Merchandising Agreement (this “Agreement”) is made and entered into to be effective as of June 5, 2009 between One Earth Energy, LLC, an Illinois limited liability company (“Ethanol Producer”), and Lansing Ethanol Services, LLC, a Delaware limited liability company (“Lansing”). Each of Ethanol Producer and Lansing may be referred to herein as a “Party,” and collectively as the “Parties.”
