These Guidelines are being issued as per sub-section (4) of section 3 of the Act. As per the provisions of the Act, a farmer may enter into a Farming Agreement for the sale of any farming produce before the actual production takes place. This land has been under cultivation and irrigated by circular “pivot” sprinklers for many years, however we purchased the land without water rights. This means that irrigated farming is no longer a possibility. The soils on this land are thin and rocky, and very marginal without irrigation. This makes them undesirable for dry farming. Jim Beard has been farming this land for many years and was told last summer that he would have 4 to 5 more years to farm it. On that assumption, last fall he cultivated and applied Roundup against quack grass, so he already has some money into it. Due to the accelerated schedule for the shift, we have just informed him that this year will be the last year of farming before construction. Jim Beard will plant a durable grass like orchard grass as well as barley this spring. The barley will act as a cover or “nurse” plant for the grass to help it get established.
