At the city commission meeting on August 22, 2016, the fourth restated Arts, Beats, and Eats (ABE) festival agreement was considered and given approval. However, the city commission was desirous to have the agreements term extended for an additional two-years and the festival owner, Mr. Jon Witz, was also desirous of the same, but needed assurances regarding pending development projects within the festival footprint that could present cost prohibitive operating expenses.

Approval of Amendment to Arts, Beats and Eats Fourth Restated Festival Agreement

A request was received from the president of Arts, Beats & Eats, Jon Witz to amend the fourth restated festival agreement (Attachment 1). The agreement, approved in October 2016, allowed the event organizer to increase gate fees from $5.00 to $7.00 beginning with the 2018 festival. In order to contract more national level talent, the organizer is requesting to begin the gate fee increase for this year’s event. The increase would apply to tickets purchased after 5:00 pm Friday, Saturday and Sunday; and after 3:00 pm on Monday.

This First Amendment to the Fourth Restated Festival Agreement (“Agreement”) is entered into this day of June, 2017 by and between the City of Royal Oak (“City”), a Michigan Municipal Corporation; the City of Royal Oak Downtown Development Authority (“DDA”), a public body corporate created pursuant to Act 197 of 1975, as amended, both with offices located at 211 Williams St., Royal Oak, MI 48068; and Arts, Beats and Eats, Inc., (“ABE”), a Michigan corporation with offices located at 301 West Fourth Street, LL 150, Royal Oak, MI 48067.
