THIS AGREEMENT (hereinafter the “Contract” or the “Agreement”) is made this 20th day of September, 2013, by and between the People of the State of New York, acting by and through the Commissioner of the Office of General Services (OGS), whose office is on the 41st Floor, Tower Building, Governor Nelson A. Rockefeller Empire State Plaza, Albany, New York 12242 (hereinafter referred to as the “State” or “OGS”) and Mirabito Holdings Inc having its principal place of business at 49 Court Street, PO Box 5306, Binghamton NY (hereinafter referred to as the “Contractor”). OGS and the Contractor are collectively referred to as the “Parties.”

There are no bonds for this Contract. The Commissioner of OGS has determined that no performance or payment bond, or negotiable irrevocable letter of credit or other form of security for the faithful performance of the Contract is required at any time during the term of this Contract. 27
