Contract Type FiledDecember 3rd, 2018On February 3, 1993, the City of Berkeley, the California State Historic Preservation Officer (SHPO), and the Advisory Council on Historic Preservation (ACHP) executed the Programmatic Agreement (PA) pursuant to Title 36 of the Code of Federal Regulations (CFR), Part 800.14(b) for properties affected by use of revenue from the Department of Housing and Urban Development (HUD) Part 58 programs. Under 24 CFR Part 58, the City is the Responsible Entity and assumes the responsibility of HUD for environmental review, decision-making, and action. A component of the environmental review is historic preservation. Section 106 of the National Historic Preservation Act (NHPA) requires that a federal agency take into account the effect of their undertaking on historic properties and afford ACHP and SHPO a reasonable opportunity to comment on such undertakings. The PA streamlines that process by laying out the agreed upon terms and conditions to resolve potential adverse effects of a Federal agency
