and entered into this day of , 2019 (the “Effective Date”), by and between the CITY OF LEXINGTON, NEBRASKA, a municipal corporation duly organized and existing under the Constitution and laws of the State of Nebraska (“City”), and PRAIRIE FIRE DEVELOPMENT GROUP, LLC, a Kansas limited liability company (“Developer”).

Submitted for your approval and execution is the attached agreement between the Board of County Commissioners and the City of Owasso for infrastructure improvements consisting of replacing Hale Acres Waterline along E 112th St. N from the western edge of the Hale Acres Subdivision to N Garnett Rd through June 30, 2023. The City shall be allocated $159,894.62 from Fiscal Year 2022 Tulsa County CDBG Urban County funds as further described in the attached.
