This Third Amendment to Intergovernmental Agreement (“Third Amendment”) is made and entered into as of this day of September 2019, between the TOWN OF LYONS, a statutory municipal corporation organized under the laws of the State of Colorado and acting by and through its Water Fund, an Enterprise of the Town of Lyons (“Lyons”), and the CITY OF LONGMONT, a municipal corporation organized under the laws of the State of Colorado and acting by and through its Water Utility Enterprise (“Longmont”). Lyons and Longmont may be referred to herein individually as a “party” or collectively as “parties.”
