Compacts are agreements between two or more states that bind them to the compacts’ provisions, just as a contract binds two or more parties in a business agreement. As such, compacts are subject to the substantive principles of contract law and are protected by the constitutional prohibition against laws that impair the obligations of contracts (United States Constitution, Article I, Section 10).

The body corporate and politic, heretofore created and known as the Delaware River Joint Commission hereby is continued under the name of the Delaware River Port Authority (hereinafter in this agreement called the "Commission"), which shall constitute the public corporate instrumentality of the Commonwealth of Pennsylvania and the State of New Jersey for the following public purposes, and which shall be deemed to be exercising an essential governmental function in effectuating such purposes, to wit:

APALACHICOLA-CHATTAHOOCHEE-FLINT RIVER BASIN COMPACT

This Act shall be known and may be cited as the "Apalachicola-Chattahoochee-Flint River Basin Compact" and shall be referred to hereafter in this document as the "ACF Compact" or "Compact."

This bill authorizes Missouri to enter into an interstate agreement known as the Agreement Among the States to Elect the President by National Popular Vote Act in order to elect the President of the United States with a majority of the popular vote. Currently, electors to the Electoral College typically favor the presidential candidate receiving the majority of their state’s popular vote for president. The state agreement requires the chief election official of each state to designate electors to the Electoral College that will vote in favor of the presidential slate receiving a majority of the votes cast nationwide. Methods for ensuring the accuracy of the national popular vote are specified.

NATURAL RESOURCES AND ENVIRONMENTAL PROTECTION ACT (EXCERPT)

This agreement may become effective within any compacting state at any time as prescribed by that state, and shall become effective within those states ratifying it whenever any 3 of the states of Texas, Oklahoma, California, Kansas, and New Mexico have ratified and congress has given its consent. Any oil-producing state may become a party hereto as hereinafter provided.

28E.9 Status of interstate agreement.

If an agreement entered into pursuant to this chapter is between or among one or more public agencies of this state and one or more public agencies of another state or of the United States said agreement shall have the status of an interstate compact. Such agreements shall, before entry into force, be approved by the attorney general who shall determine whether the agreement is in proper form and compatible with the laws of this state.
