DEFINITIONS. “Seller” means Software FX, Incorporated. “Buyer” means individuals or organizations identified on the face of the invoice. “Software” means any computer software and related documentation available from Seller. Software includes computer software owned by Seller, third party computer software that has been provided for use in association with Seller's software and computer software that has been custom designed or modified for Buyer. “Products” means any or all Software, Goods and Services.

The following terms and conditions are agreed to by SMB MACHINERY SYSTEMS, LLC ("SMB") and the buyer (“Buyer”) of the items listed on the face hereof (“Machinery”). The acceptance of Buyer’s order is subject to these terms and conditions, all of which are accepted by Buyer, and supersede anything to the contrary contained in any prior communication (whether oral or written) between SMB and Buyer. These TLC Invoice Terms and Conditions (“Terms”) apply to all TLC Invoices issued by The Living Company (“TLC”) to customers (the “Customers”) for the sale and delivery of TLC products (the “Products”) anywhere in the world. By signing or accepting a TLC Invoice for Products, or by using this website, the Customer agrees to these Terms. If the Customer does not agree completely with these Terms, do not purchase Products from TLC and do not use this website (the “Site”).
