Regulatory Filings - On March 18, 2010, in accordance with KHSA Sections 4.1.1 and 7.3.9, PacifiCorp filed its Economic Analysis and requested the California and Oregon Public Utility Commissions establish customer surcharges to collect the customer contribution towards dam removal costs and adjust the depreciation schedule for the Klamath hydroelectric facilities in contemplation of their potential removal in 2020. On September 16, 2010, the Oregon Public Utility Commission (OPUC) issued a final order affirming the dam removal surcharges for Oregon customers and a depreciation schedule for the facilities that provides for removal in 2020. The OPUC order is available at http://apps.puc.state.or.us/orders/2010ords/10-364.pdf. The Oregon customer surcharge of $172 million over ten years will provide approximately $184 million in funding for dam removal in 2020. This document presents the current status of water quality studies and pilot projects now underway pursuant to Interim Measure 11 of the Klamath Hydroelectric Settlement Agreement (KHSA). Interim Measure 11 is intended to improve water quality in the Klamath River during the interim period leading up to dam removal under the KHSA. The emphasis of Interim Measure 11 is nutrient reduction projects to provide benefits to the mainstem Klamath River that will benefit environmental resources following potential dam removal, while also addressing water quality, algal and public health issues in reservoirs of the Klamath Hydroelectric Project and dissolved oxygen in J.C. Boyle reservoir. PacifiCorp worked with representatives of the KHSA Interim Measures Implementation Committee (IMIC) to develop study plans for six studies and pilot projects to be implemented prior to the Secretarial Determination with funding provided by PacifiCorp. This document describes the proposed studies or pilot projects that PacifiCorp will conduct during 2018 to address the IM 11 objectives as described above. These proposed studies or pilot projects will be a continuation of, or build upon, IM 11 studies that have been conducted since 2010. A draft version of this Study Plan was circulated with a request for IMIC comments on January 17, 2018 and was discussed at the January 18, 2018 IMIC meeting. This final Study Plan was created by incorporating comments from the IMIC. This Study Plan is considered to be part one because there are likely to be other efforts undertaken under IM 11 in 2018 that have not yet been identified. The Klamath Hydroelectric Settlement Agreement (KHSA; as amended on November 30, 2016) includes Interim Measure 11 (Interim Water Quality Improvements), which is intended to address water quality improvement in the Klamath River during the interim period leading up to potential dam removal. Regarding Interim Measure (IM) 11, the KHSA states “The emphasis of this measure shall be nutrient reduction projects in the watershed to provide water quality improvements in the mainstem Klamath River, while also addressing water quality, algal and public health issues in Project reservoirs and dissolved oxygen in J.C. Boyle Reservoir.” The measure calls for PacifiCorp to spend up to $250,000 per year1 for studies or pilot projects in consultation with the Interim Measures Implementation Committee2 (IMIC).
