The Member acknowledges having been informed and hereby agrees that the Club and its owners, directors, officers, employees, agents and affiliates (the “Club Affiliates”) shall not be liable in lawsuits including negligence lawsuits brought against them by the Members or their guests. As material consideration for the Club permitting the Members and their guests to use the Club or its facilities, each Member and guest specifically assumes all risks of personal injury, property loss, or damages whatsoever including risks associated with racquet sports, aerobics, fitness equipment, exercise, locker room, sauna, dining or parking. This assumption of risk also includes environmental, theft, and contagion risks in addition to risk associated with use of the Club’s equipment, facilities or health and fitness advisory services.
