BETWEEN (give details of merchant establishment)(more particularly described in item no.2 ofthe schedule)…………………………………………………………………………………………… the person named in Item No.2 of the Schedule, having its address/office(s) at the address mentioned in Item No. 2 of the Schedule hereunder written (hereafter referred to as the ‘Merchant’ which expression shall unless it be repugnant to the context or meaning hereof shall be deemed to mean and include (1) in the case the Merchant being a sole proprietary concern/individual, the heirs, administrators, executors, legal representatives and permitted assigns of the Proprietor, (2) in the case of the merchant being a partnership firm, the partners for the time being and from time to time of the firm, the survivor of survivors of them, their respective heirs, administrators, executors, legal representatives and permitted assigns and (3) in the case of the Merchant being a company, its successors and assigns (as the case may be) of the ONE PART
