This Software License Agreement (the "Agreement"), effective on the date of its download or other form of delivery (the "Effective Date"), is entered into between Lumina Networks, Inc. ("Lumina") and the individual, entity, person, using software, documentation or other deliverables delivered by Lumina Networks with this license or in relation thereto ("Licensee" or “You”). Read this Agreement before downloading, installing or using the Licensed Software as Lumina is only willing to license the Licensed Software to you and provide related maintenance or other services if you accept all the terms of this Agreement. By installing or using any software provided by Lumina with this Agreement you will be deemed to have accepted this Agreement. If you do not agree to all the terms of this Agreement then do not download, install or use the Licensed Software and return it or certify its destruction immediately. Upon such certification or return Lumina Networks will refund any fee you have paid
