The Third Party Administrator, as a contractor to the Centers for Medicare & Medicaid Services (CMS), and the Manufacturer, on its own behalf, and per the Medicare Coverage Gap Discount Program Agreement the Manufacturer signed with CMS for purposes of sections 1860D-14A and 1860D-43 of the Social Security Act (the Act), as set forth in the Patient Protection and Affordable Care Act of 2010 Pub. L. 111-148, and the Health Care and Education Reconciliation Act of 2010, Pub. L. 111-152, collectively known as the Affordable Care Act, hereby agree to the following:
