This beverage agreement (this “Agreement”) between, on the one hand, PEPSICO SALES, INC. and PEPSI-COLA ADVERTISING AND MARKETING, INC. (collectively, “Pepsi-Cola”), each a Delaware corporation and a wholly-owned subsidiary of PepsiCo, Inc.
