The City of North Charleston and/or the North Charleston Farmers Market Committee and its agents, successors and/or assigns, shall not be liable for any damages whatsoever, including property damage and/or personal injury to any Market Participant, its agents, employees, guests, successors and/or assigns, which may occur on or about any part of the City of North Charleston being used for the North Charleston Farmers Market regardless of how such injury or damage may have occurred. Market Participant waives any claim against the City of North Charleston and the North Charleston Farmers Market Committee for any liability, damages, or expenses arising out of any claim for injury or damage to any person(s) or property or of any kind whatsoever, together with all costs in connection with the defense, including attorney’s fees. WHEREAS, on August 11, 2014, the City of North Charleston (“City”) entered into Voluntary Cleanup Contract 14-5044-NRP (“VCC”) with the South Carolina Department of Health and Environmental Control (“Department”) pursuant to the Brownfields/Voluntary Cleanup Program, S.C. Code Ann. § 44-56-710 et. seq. (as amended); the South Carolina Hazardous Waste Management Act (HWMA), S.C. Code Ann. § 44-56-10, et. seq. (as amended), the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), 42 U.S.C. §§ 9601, et seq., and the South Carolina Pollution Control Act, § 48-1-10 et. seq., with respect to the certain parcels of property located at the former Charleston Naval Complex, North Charleston, South Carolina (“CNC”). This Contract initially addressed the transfer of approximately 62 acres to the City.
