I am proud to say I was one of the people who signed the Agreement on behalf of Inuit, along with the other members of NTI’s executive and several others who continue to play important roles in Nunavut.

In 1993, the government of Canada and the Inuit of the high Arctic signed the Nunavut Land Claims Agreement, which created the new territory of Nunavut. According to Michael Mifflin, this strengthened Canada’s sovereign claim over its Arctic lands and waters. But 15 years later, he says, Canada’s credibility is waning because the federal government has not lived up to its commitments, notably to create a government that is representative of the population. Here, he critically examines the delays in implementing the Agreement, the persistent social gaps and the problems Nunavut faces in terms of fiscal autonomy and governance. He suggests that granting Nunavut provincial status could help solve several of these problems as well as reinforce Canada’s sovereignty claims.

The Nunavut Land Claims Agreement (NLCA) is a land claims agreement within the meaning of Section 35 of the Constitution Act, 1982. Because Inuit are an integral part of the ecological systems within which they live, their relationship to the environment and to the wildlife with which they share their Arctic home is profound. In negotiating the NLCA, Inuit put the protection and management of the land and marine environment above all else. Approximately seventy percent of the land claim is concerned with environmental protection, conservation and the wise management of the land and marine environment.

Although the ice-strengthened navy patrol vessels to be deployed from Ikpiarjuk on Baffin Island are an important component of Canada's Arctic sovereignty strategy, there is more than one way to skin a cat, says Terry Fenge, formerly with the Inuit Circumpolar Conference Canada. The federal government should involve the Inuit in Canada's Arctic sovereignty, as supported by provisions in the 1993 Nunavut Land Claims Agreement dealing with monitoring and offshore management, he says. Yet, these have not been implemented, and Ottawa seems to have forfeited the opportunity to use them to shore up sovereignty. “[E]ngaging the region’s Inuit with a view to jointly ensuring that the obligations, duties, and objectives of the Nunavut, Inuvialuit, Nunavik and Nunatsiavut Land Claims Agreement are fulfilled,” he says, is key to the Integrated Northern Strategy, promised in the recent Throne Speech.

The Nunavut Land Claims Agreement (NLCA) is many things, a modern day land claim, a treaty within the context of Section 35 of the Constitution Act, a contract or agreement between the Inuit of Nunavut, Government of Canada, and Territorial Government. Each of these different constructs has different legal implications, especially in their interpretation within the legal system. In addition to binding the signatories to the NLCA, it also binds third parties through the Nunavut Act, Nunavut Land Claims Act, Constitution Act, 1982 and Charter of Rights and Freedoms.
