This OPS Terms and Conditions for ERISA Retirement Plans (“Agreement”) is made by and between the plan named in the associated Master Terms of Service and Use Agreement (“Plan”, “You”, or “Your”) and Orion Portfolio Solutions, LLC ("OPS", “We” or “Our” or “Us”), located at 17605 Wright Street, Omaha, Nebraska 68130. You have been provided this Agreement as part of the retirement plan proposal, and You acknowledged receipt and acceptance of this Agreement by executing the Agreement’s signature page. In addition, by clicking on “I ACCEPT” the first time You access and use the OPS website (“Website”), You are acknowledging and agreeing that this Agreement applies each time You use the Website; You also acknowledge and agree to the OPS Website Terms of Use (“Website Terms”), which can be found at www.orionportfoliosolutions.com.
