The provisions set forth in this Amendment are being added to the Agreement to comply with legislative and regulatory requirements of the State of Alabama regarding provider contracts with providers rendering health care services in the State of Alabama. To the extent that such Alabama laws and regulations are applicable and/or not otherwise preempted by federal law, the provisions set forth in this Amendment shall apply and, to the extent of a conflict with a provision in the Agreement, shall control. The provisions set forth in this Amendment do not apply with regard to Covered Services rendered to Participants covered under self-funded plans.

Duties and Obligations for the Parties (Pages 2 and 3): This is a very important section that lays out what CPESN does for the pharmacy and what the pharmacy, in turn, must do to participate. This is the section that requires the pharmacy to follow all of the standards set forth by the workgroups and the boards and provides much of the basis for clinical integration. It also prescribes the use of shared technologies like the Pharmacy Finder and also contains the requirement for joining at least one of the chaptered Networks.
