This PATENT LICENSE AND RELEASE AGREEMENT (this “Agreement”) is made and entered into as of July 3, 2012 (the “Effective Date”) by and between Broadcom Corporation, a corporation duly organized and existing under the laws of California, having its principal place of business at 5300 California Avenue, Irvine, California 92617 (“Broadcom”), and Emulex Corporation, a corporation duly organized and existing under the laws of Delaware, having its principal place of business at 3333 Susan Street, Costa Mesa, California 92626 (“Emulex”).
