The following PlayerMaker Service Terms and Conditions ("Terms") are hereby incorporated by reference into the Order (as defined below). These Terms together with the Order, the SLA and the DPA (as such terms are defined below) are made part of the Subscription Agreement entered into between you (a Customer, as defined below) and the Motionize or PlayerMaker entity indicated in your Order (as defined below) ("PlayerMaker", "we", "our" or "us") and govern your access to, and use of: (i) the PlayerMaker software-as-a-service platform and related documentation, and features, as well as any fixes, updates or upgrades thereto ("Software") as well as any support and maintenance of the same (subject also to the SLA, which shall take precedence in the event of any inconsistency with these Terms); (ii) the PlayerMaker mobile software application ("App"); (iii) the PlayerMaker sensors and any related equipment provided to you by PlayerMaker ("Device"), ((i) - (iii) hereinafter referred to as the
