which is or will be a qualifying facility as defined by the Federal Energy Regulatory Commission ("FERC") pursuant to Section 210 of the Public Utility Regulatory Policies Act of 1978, consisting of a 4.68 kilowatt photovoltaic solar array and a 3.8 kilowatt SMA Sunnyboy 3800U inverter (the "Facility"), which is located at 405 Martin Luther King Boulevard near Chapel Hill, North Carolina.
