These Product Terms of Use (“Terms of Use”) form a binding, legal contract between Datto, Inc. or one of our subsidiaries or affiliates depending on where you are located (“Datto” or “us”) and you regarding your access to and use of Datto image-‐based business continuity and disaster recovery products (referred to in these Terms of Use as the “Product” or “Products”).

These Product Terms of Use (the “Product Terms of Use”) supplement and are pursuant to the Master Services Agreement and set out the terms under which Radar Labs, Inc. (“Radar”) agrees to license its Services to the person or entity reading and agreeing to these Product Terms of Use (the “Licensee” or “you”). You signify your agreement to these Product Terms of Use by signing the Order Form or by using the Services in any way. In the event of a conflict between the documents comprising this Agreement, the documents will control in the following order (from most to least controlling): the Order Form, the Master Services Agreement, these Product Terms of Use, the Service Level Agreement, the Privacy Policy, and the Data Processing Agreement. Any terms we use in this Product Terms of Use without defining them have the definitions given to them in the Order Form or Master Services Agreement.
Nomadix® Cloud TelephonyProduct Terms of Use • June 6th, 2023
These Product Terms of Use (“Terms”) are a part of the Nomadix End User License Agreement (“EULA”). Both the EULA and these Terms are applicable to the use of the Nomadix Cloud Telephony Product by the entity that has subscribed to and licensed the Product (the “End User”). The End User acknowledges and agrees that the Product is provided by Nomadix as a service and on a subscription basis only as more fully set forth in the Nomadix Product Terms and Conditions found here. Nomadix always retains ownership of and title to the Product. End User acknowledges and agrees that neither End User nor any of its permitted third-party users (e.g., guests, employees, and other ultimate users (together, “Permitted Users”)) offered use of the Product by End User, are purchasing nor shall hold title to the Product.
